Guest Insurance and 

Protection Conditions


1. Liability Insurance: 

Applies for both Risk Taker and Peace of Mind.

If the guest is at fault in a vehicle collision this liability policy will protect all Authorized drivers listed on the rental agreement to the maximum of $1,000,000 for bodily injury and property damage claims against the guest by a third party.

In the first instance the guest is required to prove to Mighway USA, Inc liability insurer's satisfaction that they attempted to make a claim under their own personal liability policy and either the claim has been turned down, the policy limit has been exhausted or the guest does not have any valid personal liability insurance. Once this has been proven then the Mighway Liability insurance will protect the guest to a maximum of $1,000,000 for bodily injury and property damage claims against the guest by a third party - subject always to the following;

Non covered damages - the guest has full legal and financial responsibility in case of:

- Breach or violation of the rental contract

- damages and collisions caused by vehicle abuse or misuse for illegal activities

- damages and collisions caused under the influence of alcohol, drugs or other controlled substances.

- operation of the vehicle by anyone not listed on the rental contract or not having a valid driver license.

- guest and passenger injury

- guest and passenger personal property damage.

 

Please note: personal property or personal damages are never covered.


2. Vehicle Damage Waiver

Applies for both Risk Taker and Peace of Mind - you will find your stated deductible in your chosen policy. Pricing is at the bottom on the page. 

In the event of accidental(1) damage or loss to the vehicle(2) by way of vehicle collision, vandalism, windshield & glass breakage, fire & theft, then the guest will be insured for the costs in excess of the stated deductable to repair to the vehicle.

Please note: regardless of fault the guest will be required to pay the deductible in the event of a valid claim. The deductible is applicable for all types of covered damage, including windshield.

  1. Accidental is defined as: sudden and unforseen event causing physical loss or damage to the vehicle that is not intended or expected by you.
  2. Vehicle is defined as: the vehicle as described on your rental agreement and includes fixtures, fittings, furniture, furnishings, awnings and equipment supplied and fitted by the manufacturer or purchased and fitted to the vehicle following manufacture and that are permanently contained on or within the vehicle you have hired.

Option 1: RISK TAKER

In the event of a valid claim, you will need to pay a deductible of up to US$4,500 in respect of each claim.  You will be advised of the deductible amount which will apply at the time of booking. This is payable regardless of fault. If it is then deemed that you are not at fault in an accident this amount will be refunded to you.


What the RISK TAKER policy DOES NOT cover

The insurance will be void and the Guest will be liable and responsible for the full costs (including costs of any Damage) if:

  1. the Guest breaches any of the Terms, and that breach is the cause of or contributes to the relevant Damage; or
    1. the Damage is caused by willful misconduct (e.g. sitting or standing on the hood or roof of the Vehicle), or driving under the influence of alcohol or drugs, or negligence or where the Guest is determined by local authorities to have been careless, negligent or willful in failing to abide by the local road rules.


In addition to the above, the policy does not cover and the Guest will be liable and responsible in full for:

  1. any loss or damage to any personal belongings or property of the Guest (or any person or entity related to the Guest); 
    1. retrieving or recovering a Vehicle which may include, but is not limited to, a Vehicle that has become bogged, submerged, caught, trapped, stuck or restricted in any way and/or has been abandoned, in each case in circumstances within the control of the Guest;
    2. replacing keys which have been lost or stolen, or retrieving keys which have been locked in the Vehicle; 
    3. any overhead or underbody damage to the Vehicle however caused;
    4. any damage caused to the Vehicle due to the use of snow chains; 
    5. breakdown being any inability to operate, breakage, breakdown or failure of any component or accessory, the engine, transmission, mechanical, electrical, alarm or electronic systems or any loss that their failure causes to the rest of these systems unless the breakdown is caused by collision or impact damage, earthquake, fire, flood, lightning, a malicious act, overturning of the vehicle, theft or illegal conversion or volcanic eruption;
    6. damage to tires by application of brakes or by punctures, cuts or bursts or bursting unless the vehicle suffers other loss or damage in an accident or the damage is deliberate and is caused by a person not insured by this policy;
    7. any accommodation or replacement vehicle costs that the guest incurs as a result of an accident or mechanical breakdown;
    8. any compensation for loss of time or travel delay;
    9. Any damages or losses resulting from off-road usage or driving in the following places: through or into the Death Valley region between June 15-September 15, travelling on any private, gravel, dirt, fire, or logging road and other non-public roads, beaches, restricted areas etc., travelling into Mexico, travelling in or through the inner cities of New York, Montreal, and Quebec City (Canada);
    10. damage resulting from guest negligence e.g. backing up without a guide, following incorrect GPS directions etc;
      1. damages to the interior of the vehicle;

      2. damages caused by entering any parking structure;

      3. damages caused by freezing, e.g. vehicle not winterized), or overheating of vehicle or systems;

      4. deliberate and willful damages caused by the guest or passengers;

      5. damages caused by neglecting proper operating procedures, e.g. incorrect fuel type & quality, ignoring oil or coolant or air pressure levels, ignoring any warning lights, setting or using incorrect power voltage etc;

      6. damages or collisions caused under the influence of alcohol, drugs or other controlled substances 

      7. damages caused by overloading the vehicle and/or exceeding the legal towing capacity (towing limit with proper equipment is 1,500lbs) 

      8. damages caused by carrying more passengers than having seatbelts. 

    11. Any windshield damage, replacement or chip repair 



Option 2: PEACE OF MIND


In the event of a valid claim you will need to pay a deductible of up to US$500 in respect of each claim.  You will be advised of the deductible amount which will apply at the time of booking. This is payable regardless of fault. If it is then deemed that you are not at fault in an accident this amount will be refunded to you.


What the PEACE OF MIND policy DOES NOT cover


The insurance will be void and the Guest will be liable and responsible for the full costs (including costs of any Damage) if:

  1. the Guest breaches any of the Terms, and that breach is the cause of or contributes to the relevant Damage; or

The Peace of Mind Policy DOES cover:


  1. In the event of a flat or punctured tire, the Peace of Mind policy will cover the cost incurred by CoachNet service providers needing to either change the damaged tire with the vehicle's spare tire or indeed replacing the damaged tire with a new tire.
    1. In the event of a mechanical breakdown, the Peace of Mind policy will cover the cost of providing alternative accommodation up to the value of the daily rate you have paid for the vehicle.  Mighway will provide you with the closest available suitable accommodation.  While you may choose to not accept the accommodation offered by Mighway, Mighway is not obliged to pay or reimburse you for accommodation you have sourced or identified yourself.
    2. In the event of a mechanical breakdown, Mighway will cover the costs of providing alternative transportation up to the value of the daily rate you have paid for your vehicle.  Whilst Mighway will endeavour to find you a replacement vehicle of a similiar nature to that which you have rented, during peak hire periods this may not always be possible in which case Mighway will either offer you an alternative vehicle or an alternative form of transportation up the value of the daily rate you have paid for your vehicle. You may choose to not accept the alternative transportation offered by Mighway, in which case Mighway will agree to terminate your rental agreement and immediately refund to you the value of the remaining days of the rental agreement.
    3. Any windshield damage, replacement or chip repair



Important Information

United States legislation provides limited coverage for personal injury.  This policy does not provide any liability for personal injuries sustained during the Rental, nor for any loss or damage to any personal belongings or property of the Guest (or any person or entity related to the Guest).  We also have no liability for any costs or losses sustained by a Guest as a result of any disruption or changes to travel plans required or arising out of your rental of a Vehicle (including because of any breakdown of a Vehicle). Mighway strongly recommends that you take out personal travel insurance to cover any injury, loss and disruption to travel plans.

Correctness of Statement and Fraud
All statements made by you or on your behalf on any of these forms or otherwise in support of this policy or any claim must be complete and correct in all respects. If any claim under this policy is supported by any incorrect information or statement all benefits will be forfeited.

Governing Law
This policy is governed by United States law and the United States courts have exclusive jurisdiction over any legal proceedings about it.
