Guest Insurance and 

Protection Conditions

1. Liability Insurance: If the guest is at fault in a vehicle collision this liability policy will protect all Authorized drivers listed on the rental agreement to the maximum of $1,000,000 for bodily injury and property damage claims against the guest by a third party.

In the first instance the guest is required to prove to Mighway USA, Inc liability insurer's satisfaction that they attempted to make a claim under their own personal liability policy and either the claim has been turned down, the policy limit has been exhausted or the guest does not have any valid personal liability insurance. Once this has been proven then the Mighway Liability insurance will protect the guest to a maximum of $1,000,000 for bodily injury and property damage claims against the guest by a third party - subject always to the following;

Non covered damages - the guest has full legal and financial responsibility in case of:

- Breach or violation of the rental contract

- damages and collisions caused by vehicle abuse or misuse for illegal activities

- damages and collisions caused under the influence of alcohol, drugs or other controlled substances.

- operation of the vehicle by anyone not listed on the rental contract or not having a valid driver license.

- guest and passenger injury

- guest and passenger personal property damage.

 

Please note: personal property or personal damages are never covered.


2. Comprehensive, Collision, Vandalism, Windshield & Glass, Fire & Theft Insurance.

In the event of accidentaldamage or loss to the vehicle2 by way of vehicle collision, vandalism, windshield & glass breakage, fire & theft, then the guest will be insured for the costs in excess of the stated deductable to repair to the vehicle.

Please note: regardless of fault the guest will be required to pay the deductible in the event of a valid claim. The deductible is applicable for all types of covered damage, including windshield.

1 Accidental is defined as: sudden and unforseen event causing physical loss or damage to the vehicle that is not intended or expected by you.

2. Vehicle is defined as: the vehicle as described on your rental agreement and includes fixtures, fittings, furniture, furnishings, awnings and equipment supplied and fitted by the manufacturer or purchased and fitted to the vehicle following manufacture and that are permanently contained on or within the vehicle you have hired.


Non covered damages -this policy will be void and the guest has full legal and financial responsibility in cases of:

- guest negligence e.g. backing up without a guide, following incorrect GPS directions etc

- breach or violation of the rental contract

- damages to the interior of the vehicle

- damages caused by entering any parking structure

- damages caused by freezing. eg vehicle not winterized, or overheating of vehicle or systems

- deliberate and wilful damages caused by the guest or passengers

- damages caused to the vehicle by abuse or misuse for illegal activities

- damages caused by neglecting proper operating procedures, e.g. incorrect fuel type & quality, ignoring oil or coolant or air pressure levels, ignoring any warning lights, setting or using incorrect power voltage etc

- damages and losses caused during travel in or thru restricted areas, beaches, and damages due to "off-road" useage

 - damages and collisions caused under the influence of alcohol, drugs or other controlled substances.

- damages caused by overloading the vehicle and/or exceeding the legal towing capacity (towing limit with proper equipment is 1,500lbs)

- damages caused by carrying more passengers than having seatbelts.

- operation of the vehicle by anyone not listed on the rental contract or not having a valid driver license.

- any costs for retrieving or recovering a vehicle which may include, but is not limited to, a vehicle that has become bogged, submerged, caught, trapped, stuck or restricted in any way and/or has been abandoned, in each case in circumstances within the control of the Guest;

- any costs for replacing keys which have been lost or stolen, or retrieving keys which have been locked in the vehicle;

- damage caused to the vehicle due to the use of snow chains;

- damage to tires by application of brakes or by punctures, cuts or bursts or bursting unless the vehicle suffers other loss or damage in an accident or the damage is deliberate and is caused by a person not insured by this policy

- damage caused by using the vehicle within the Death Valley region between June 15-September 15

 - damage caused by using the vehicle within Mexico.



Vehicles are NOT PERMITTED in the following locations, roads and regions. This policy will be void and the guest has full legal and financial responsibility in cases of:

- travelling thru or into Death Valley region between June 15-September 15

- travelling into Mexico.

- travelling on any private, gravel, dirt, fire or logging road and other non public roads, beaches etc

- travelling in or thru the inner cities of New York, Montreal & Quebec City (Canada).

Please note: personal property or personal damages are never covered.

2a Deductible:

Regardless of fault the guest will be required to pay the applicable deductible by way of deduction or forfeiture of security deposit paid at time of vehicle pickup.

In the event of Accident/3rd party collision - WITH  injury or serious damage to the vehicle(s)

1. Call the police and have them take a report. Take note of the officer's name, ID, the case number and contact information to request the report.

(If there is injury that requires an emergency response dial 911)

2. Call Mighway Roadside Support Partner (Coach-Net) (844) 462 9510 (24hr) and advise of the damage and complete the collision/damage report. Where possible take pictures to provide. Coach Net will then assist with temporary repairs or movement of vehicle.


In the event of Accident/3rd party collision - WITHOUT injury or serious damage to the vehicle(s)

1. Call Mighway Roadside Support Partner (Coach-Net)  (844) 462 9510 (24hr) and advise of the damage and complete the collision/damage report. Where possible take pictures to provide. Coach-Net will then assist with temporary repairs or movement of vehicle.


3. Mechanical breakdown

The guest will NOT be liable for and costs relating to mechanical breakdown to the engine, transmission, mechanical, electrical, alarm or electronic systems or any loss that their failure causes to the rest of these systems UNLESS the breakdown is caused by

- neglecting proper operating procedures, eg incorrect fuel type & quality, ignoring oil or coolant or air pressure levels, ignoring any warning lights, setting or using incorrect power voltage etc

- abuse or misuse for illegal activities
